These Website Terms of Use (“Terms”) govern your access to and use of our websites, online portals, webpages, forms, listings, and related online services that link to these Terms (collectively, the “Site”).

Please read these Terms carefully. By accessing or using the Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Site.

The Site provides general information about A1 Properties, property-management services, available rental properties, and related services. It may also allow users to submit inquiries, applications, maintenance requests, documents, payments, or other information.

Nothing on the Site creates a landlord-tenant relationship, property-management relationship, agency relationship, contractual obligation, or other legal relationship unless the parties enter into a separate written agreement.

2. ELIGIBILITY AND ACCEPTANCE

You may use the Site only if you are legally capable of entering into a binding agreement. By using the Site, you represent that:

  • You have the legal authority to agree to these Terms;
  • Any information you provide is truthful, current, and complete;
  • You will use the Site only for lawful purposes; and
  • Your use of the Site will not violate any applicable law, regulation, contract, or third-party right.

If you use the Site on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

3. RENTAL LISTINGS AND PROPERTY INFORMATION

Rental listings, photographs, floor plans, measurements, descriptions, rental rates, deposits, fees, amenities, availability dates, utility information, and other property details are provided for general informational purposes and may change without notice.

Although we make reasonable efforts to keep property information accurate and current, we do not guarantee that any listing or other information will be complete, accurate, current, or free from errors.

Property availability is not guaranteed until all required screening, approval, documentation, payments, and lease-signing requirements have been completed. Submission of an inquiry, showing request, application, deposit, or other information does not guarantee approval, availability, or the right to rent a property.

Photographs may not reflect a property’s current condition, and dimensions or measurements may be approximate. Prospective tenants should independently inspect the property and confirm all information that is important to their rental decision.

Any advertised concessions, promotions, or special terms are subject to stated eligibility requirements, availability, expiration dates, and written lease terms.

4. RENTAL APPLICATIONS AND SCREENING

Submitting a rental application does not guarantee approval or create a lease or reservation. Applications may be subject to screening criteria, identity verification, income verification, rental-history review, credit review, criminal-history review where permitted by law, and other lawful qualification requirements.

Application fees, holding deposits, security deposits, and other payments are governed by the disclosures, agreements, and policies presented at the time of submission. To the extent there is a conflict between these Terms and a signed lease, application agreement, property-management agreement, payment agreement, or other written contract, the separate written contract will control.

A1 Properties administers its housing-related services in accordance with applicable fair-housing and anti-discrimination laws.

5. NO EMERGENCY OR FORMAL NOTICE THROUGH THE SITE

Unless A1 Properties expressly confirms otherwise in writing, general website forms, email addresses, text messages, social-media accounts, and online contact forms must not be used to:

  • Report a life-threatening emergency;
  • Request emergency police, fire, or medical assistance;
  • Report an active fire, gas leak, flooding event, or other immediate danger;
  • Deliver a formal legal notice;
  • Terminate a lease;
  • Exercise a legal right requiring notice in a particular form;
  • Submit a time-sensitive maintenance request; or
  • Provide notice for which a lease or law requires a specific delivery method.

Tenants must follow the maintenance-reporting and notice procedures stated in their lease or other written instructions from management. A website submission is not considered received or accepted until A1 Properties confirms receipt when confirmation is required.

6. PERMITTED USE

A1 Properties grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for your personal, lawful, and noncommercial purposes.

You may print or download reasonable portions of publicly available Site content for your personal use, provided that you:

  1. Do not alter the content;
  2. Retain all copyright, trademark, and proprietary notices;
  3. Do not use the content commercially; and
  4. Do not represent that A1 Properties endorses you, your business, or your use of the content.

No other right or license is granted except as expressly stated in these Terms.

7. PROHIBITED CONDUCT

You may not:

  • Use the Site for any unlawful, fraudulent, deceptive, abusive, or harmful purpose;
  • Submit false, misleading, incomplete, or impersonated information;

  • Copy, reproduce, republish, distribute, sell, license, publicly display, or commercially exploit Site content without authorization;
  • Remove copyright, trademark, or other proprietary notices;
  • Use the Site to harass, threaten, discriminate against, or violate the rights of another person;
  • Submit content that is unlawful, defamatory, obscene, infringing, or otherwise harmful;

9. PAYMENTS AND THIRD-PARTY PROCESSORS

You are responsible for verifying the amount, purpose, account, property, and payment information before submitting a payment. A payment is not considered completed until it has been successfully processed, received, and credited to the appropriate account.

A failed, reversed, disputed, rejected, or returned payment may remain unpaid and may be subject to charges or consequences permitted by the applicable lease, agreement, and law.

A1 Properties is not responsible for interruptions, delays, errors, or security incidents caused solely by an unaffiliated third-party payment provider, except to the extent responsibility cannot lawfully be excluded.

10. USER SUBMISSIONS

The Site may allow you to submit messages, feedback, reviews, documents, photographs, applications, maintenance information, or other materials (“User Submissions”).

You retain ownership of your User Submissions. By submitting materials, you grant A1 Properties a nonexclusive, royalty-free license to receive, store, reproduce, review, transmit, and use those materials as reasonably necessary to:

  • Respond to your request;
  • Evaluate an application or transaction;
  • Provide property-management or rental services;
  • Maintain business and property records;
  • Investigate complaints or suspected misconduct;
  • Enforce agreements or legal rights; and
  • Comply with applicable laws and lawful governmental requests.

This license does not authorize A1 Properties to publicly disclose your personal information or use it for unrelated purposes contrary to our Privacy Policy or applicable law.

You represent that you have the right to submit the materials and that doing so does not violate any law, contract, confidentiality obligation, intellectual-property right, privacy right, or other third-party right.

Do not submit confidential business ideas, trade secrets, or unsolicited creative proposals through general contact or feedback forms. General suggestions or feedback that do not contain personal or confidential information may be used by A1 Properties without compensation or restriction.

11. MONITORING AND ENFORCEMENT

A1 Properties may, but is not required to, monitor Site activity to:

  • Operate, maintain, and secure the Site;
  • Investigate suspected fraud, misuse, or unlawful activity;
  • Protect A1 Properties, property owners, tenants, applicants, users, and others;
  • Enforce these Terms and other agreements; and
  • Comply with applicable laws, regulations, court orders, and lawful governmental requests.

We may remove or restrict access to content that we reasonably believe violates these Terms, applicable law, or the rights or safety of another person.

Any monitoring or collection of personal information will be handled in accordance with our Privacy Policy and applicable law.

12. INTELLECTUAL PROPERTY

The Site and its content—including text, photographs, graphics, logos, designs, icons, videos, software, databases, layouts, and other materials—are owned by or licensed to A1 Properties and are protected by applicable copyright, trademark, and other intellectual-property laws.

The names A1 Properties Kansas City, A1 Properties Kansas City LLC, associated logos, slogans, service names, and design elements are trademarks or service marks of A1 Properties or their respective owners. They may not be copied, imitated, or used without prior written permission.

Nothing on the Site grants you ownership of or a license to any intellectual property except for the limited personal-use permission expressly provided in these Terms.

13. COPYRIGHT COMPLAINTS

A1 Properties respects the intellectual-property rights of others. A person who believes that content on the Site infringes a copyright may send a written notice containing sufficient information to identify:

  • The copyrighted work claimed to have been infringed;
  • The allegedly infringing material and its location on the Site;
  • The complaining party’s contact information;

  • DEFECTS WILL BE CORRECTED;

  • PROPERTY INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT; OR

18. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, A1 PROPERTIES AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO:

  • ACCESS TO OR USE OF THE SITE;
  • INABILITY TO ACCESS OR USE THE SITE;
  • RELIANCE ON SITE CONTENT;
  • ERRORS OR OMISSIONS IN PROPERTY INFORMATION;
  • UNAUTHORIZED ACCESS TO DATA;
  • THIRD-PARTY WEBSITES OR SERVICES; OR
  • MALWARE, SERVICE INTERRUPTION, DATA LOSS, OR DEVICE DAMAGE.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANOTHER LEGAL THEORY, EVEN IF THE POSSIBILITY OF DAMAGES WAS KNOWN.

TO THE EXTENT A1 PROPERTIES IS FOUND LIABLE FOR A CLAIM ARISING SOLELY FROM USE OF THE SITE, ITS AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO A1 PROPERTIES FOR USE OF THE SITE DURING THE SIX MONTHS BEFORE THE CLAIM OR $100.00.

These limitations do not exclude liability that cannot legally be limited or excluded.

19. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless A1 Properties and its owners, members, managers, employees, agents, contractors, and affiliates from claims, damages, liabilities, judgments, losses, costs, and reasonable attorneys’ fees arising from or related to:

  • Your unlawful or unauthorized use of the Site;
  • Your violation of these Terms;
  • Your User Submissions;
  • Your violation of another person’s rights; or
  • Fraudulent, misleading, or materially inaccurate information you submit.

This provision does not require you to indemnify A1 Properties for conduct for which indemnification is prohibited by law.

20. SUSPENSION AND TERMINATION

A1 Properties may suspend, restrict, or terminate your access to all or part of the Site when reasonably necessary to:

  • Address a violation of these Terms;
  • Prevent suspected fraud, abuse, or security threats;
  • Protect users, properties, systems, or information;
  • Perform maintenance;
  • Comply with law; or
  • Discontinue a Site feature or service.

Termination of Site access does not affect rights, obligations, payments, or liabilities arising under a lease, property-management agreement, or other separate contract.

21. CHANGES TO THE SITE OR THESE TERMS

We may modify, suspend, or discontinue any part of the Site at any time.

We may also revise these Terms periodically. Updated Terms will be posted on the Site with a revised “Last Updated” date. Changes become effective when posted unless another effective date is stated.

Your continued use of the Site after revised Terms become effective constitutes acceptance of those revised Terms. Changes will not retroactively alter the terms of a separately signed agreement unless that agreement permits such changes.

22. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

To the extent permitted by law, any legal action arising solely from these Terms or use of the Site must be brought in a state or federal court having jurisdiction in [County Name], Missouri, and each party consents to the jurisdiction and venue of those courts.

This section does not alter any venue, jurisdiction, mediation, or dispute-resolution provision contained in a separate lease or written agreement.

23. ELECTRONIC COMMUNICATIONS

By communicating with A1 Properties electronically, you consent to receive responses and records electronically where permitted by law.

Electronic communications do not replace legally required notices or signatures unless the applicable law and the parties’ agreement permit electronic delivery or execution.

You are responsible for keeping your email address, telephone number, and other contact information current.

24. SEVERABILITY

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

25. NO WAIVER

A1 Properties kansas city’ failure to enforce a provision of these Terms does not waive its right to enforce that provision or any other provision later.

26. ENTIRE AGREEMENT

These Terms and the Privacy Policy constitute the entire agreement concerning general use of the Site. They do not replace or amend any lease, management agreement, application agreement, payment agreement, or other separately executed contract.
